2 charged with insider trading over 2009 IBM deal

Two former stock brokers at a Connecticut financial services company were charged with criminal insider trading on Thursday over a 2009 acquisition by computer giant IBM Corp.

U.S. authorities said Thomas Conradt, David Weishaus and three unnamed colleagues made more than $1 million in illicit gains by trading in shares of SPSS Inc before IBM agreed on July 28, 2009, to buy the Chicago-based software company for $1.2 billion.

The criminal indictment details a trail of instant messages involving the men about their activity, some of which refer to other insider-trading cases involving homemaking doyenne Martha Stewart and the billionaire Mark Cuban.

Prosecutors said the scheme got its start with a tip from an associate at the New York law firm that represented IBM in the transaction. Prosecutors did not name the law firm, but Cravath Swaine & Moore has said it was IBM's representative.

"Thomas Conradt, David Weishaus and their co-conspirators engaged in a chain of illegal tipping simply because they wanted to get rich quick," federal prosecutor Preet Bharara said in a statement.

Conradt, 34, is a lawyer living in Denver, while Weishaus, 32, lives in Baltimore. At the time of the alleged insider trading, both were employed at Euro Pacific Capital Inc, a Westport, Connecticut-based firm, according to the Financial Industry Regulatory Authority.

Conradt and Weishaus were arrested by the Federal Bureau of Investigation Thursday morning, an FBI spokesman said.

They were each charged with three criminal counts of securities fraud and one criminal count of conspiracy in an indictment unsealed in U.S. District Court in Manhattan.

They face up to 20 years in prison and a $5 million fine on each of the securities fraud counts. Both are expected to make initial appearances in federal courts near where they live.

The U.S. Securities and Exchange Commission filed related civil fraud charges against both men.

Sharon Feldman, a lawyer for Conradt, did not immediately respond to a request for comment. Michael Grudberg, a lawyer for Weishaus, declined to comment.

Euro Pacific Capital and Cravath did not immediately respond to requests for comment. Armonk, New York-based IBM did not immediately respond to a similar request.

IBM agreed to pay $50 per share for SPSS, a 42 percent premium to SPSS' closing price on the day before the purchase was announced.

According to court papers, Conradt's roommate, an Australian equities analyst, had learned about the pending acquisition from a close friend, a New Zealand citizen who worked as an associate at the New York law firm.

Investigators said Conradt then tipped Weishaus, who in turn tipped three colleagues, who were not named in court papers. These five people placed the various improper trades in SPSS stock and options, according to the court papers.

The indictment outlines a series of instant messages involving the defendants that prosecutors said reflect their involvement in the improper trades.

In one exchange, according to the indictment, Conradt on July 1, 2009, told Weishaus, "Jesus, don't tell anyone else ... we gotta keep this in the family."

Weishaus then said, "I don't want to go to jail," said "Martha Stewart spent 5 months in the slammer," and alluded to an SEC insider-trading case against Cuban, the owner of the Dallas Mavericks pro basketball team.

On July 23, Weishaus refused to buy SPSS call options for Conradt, prompting Conradt to write, "I'm setting this deal up for everyone ... making everyone rich," according to the indictment.

The criminal case is U.S. v. Conradt et al, U.S. District Court, Southern District of New York, No. 12-cr-00887. The SEC case is SEC v. Conradt et al in the same court, No. 12-08676.?

With triple-digit year-over-year increases in adjusted net income and revenues, Walker & Dunlop, Inc. (WD - Snapshot Report) reported exceptional third quarter 2012 results earlier this month. The company expects to continue its bull run in the coming quarters as well, with $6.7 billion to $7.4 billion of loan originations in 2012 and between $8 billion and $10 billion in 2013.

Surge in Earnings Estimate Revisions

Over the past 30 days, the Zacks Consensus Estimate for 2012 has increased 4.2% to $1.75 as 3 of 4 earnings estimates moved higher, implying a year-over-year improvement of 9.7%. The Zacks Consensus Estimate for 2013 has increased 2.3% to $2.18 over the same time as half of the four earnings estimates moved upward, representing a year-over-year advance of 24.1%.

Impressive Valuation

Walker & Dunlop looks undervalued with a forward P/E multiple of 9.32 and a P/B multiple of 1.10.

Furthermore, the PEG ratio is 0.80 based on a 5-year EPS growth rate of 11.7%, which is at a 20% discount to the generally-accepted yardstick of 1.0 for a fairly valued stock. This further implies a strong future growth potential for Walker & Dunlop.

Health-care providers can play critical role in reducing and preventing intimate partner violence

In a perspective article to appear in the Nov. 29 issue of the New England Journal of Medicine, researchers from Boston University Schools of Medicine and Public Health (BUSM and BUSPH) report that health-care providers can play a critical role in helping to reduce and prevent intimate partner violence (IPV) by screening and referring patients to appropriate resources.

The U.S. Centers for Disease Control and Prevention recently released a comprehensive report on the prevalence of sexual violence, stalking and IPV in the U.S. The report relays the alarming findings that 35.6 percent of women in the U.S. are raped, assaulted or stalked by intimate partners at some point during their lives, and approximately six percent experience these events in a given year. Men are also at risk: 28.5 percent report lifetime victimization and five percent report past year victimization. The annual health care costs for women who are experiencing ongoing IPV are 42 percent higher than those for non-abused women, and it has been estimated that the cost of providing health care to adult survivors of IPV ranges from $2.3 billion to $7 billion in the first year after the assault.

Now that the Affordable Care Act requires insurance coverage to include domestic violence screening of women, physicians are taking a new look at how they respond to patients who are domestic violence survivors. There are several steps doctors should take when patients report potential IPV, including acknowledging the admission of abuse. "We advise thanking the patient for trusting the provider with the information, and expressing concern about the patient's safety," explained lead author Jane Liebschutz, MD, MPH, FACP, an associate professor of medicine and social and behavioral sciences at BUSM and BUSPH respectively.

Other steps include: asking the patient if he or she would like to be connected to IPV advocacy services; offering the patient the National Domestic Violence hotline number; considering whether child protective services are required and screening the patient for co-morbid depression, anxiety and substance abuse.

According to Liebschutz, when a patient screens negative for IPV, but providers nevertheless suspect that they are experiencing abuse, it is important that the provider not force disclosure. "It is not critical that the patient acknowledges IPV victimization in order to receive a benefit from the screening. Having asked IPV-related questions signals to the patient that the provider is caring and concerned, trustworthy and willing to discuss the topic during a future visit," she added.

Finally, providers need not receive a positive screening response in order to provide universal education about IPV. "Even if a patient screens negative, providers are encouraged to state that many patients do experience IPV at some point, and that there are many resources to help people who feel unsafe in their relationships," said co-author Emily Rothman, ScD., an associate professor of community health services at BUSPH.

School Testing In U.S. Costs $1.7 Billion, But That May Not Be Enough: Report

Matt Chingos has an idea that will likely roil the scores of parents and teachers who think the U.S. tests its students too much: we might actually spend too little on standardized testing.

But he's not alone.

"He shows, that with the debate about testing in this country -- it costs too much money -- it's absolutely wrong," said David Coleman, president of the College Board, the company that administers the SATs.

In a report released Thursday titled "State Spending on K-12 Assessments," Chingos, a fellow at the Brookings Institute, tallied up the cost of standardized testing, a subject that has fueled much debate and speculation. After sending out countless Freedom of Information Act requests and rummaging through boxes of documents, he arrived at an estimate of $1.7 billion.

"While it may seem like a lot, it's more or less a drop in the bucket," Chingos told The Huffington Post. All told, that number represents one quarter of one percent of all money spent on education. According to his calculations, ending all testing and reallocating the cost to personnel could either decrease the student-teacher ratio by .1 students per teacher, or give teachers a raise of $550.

These numbers matter because even in an environment of economic woe and budget cuts, tests are about to see the biggest wave of change since the passage of the No Child Left Behind Act, which required states to test students annually from third grade onward. Now, 45 states are preparing to adopt a new generation of tests aligned with the Common Core State Standards, a set of teaching goals aimed to get kids to think more deeply about things like fractions and evidence-based arguments, and to eventually prepare them for college or the workforce. Funding for these exams has so far come largely from the federal government, but will dry up six months before the tests' first administration.

And with testing at an inflection point, Common Core advocates are seeing this moment as a critical one in marketing their veracity to teachers. On various polls, only between 20 and 25 percent of teachers indicate that they think the standardized tests associated with NCLB are accurate reflections of their students' learning. The perceived fallibility of these exams is part of what gave NCLB such a bad rap in the first place. In fact, this week, the American Federation of Teachers launched a campaign to end the "fixation on standardized testing" (but the union does support the Common Core.)

"You get this rage up that we're wasting time testing, and you're making testing shorter and shittier," Coleman said at a Brookings panel Thursday. "And then people say the test is all multiple choice and bad. We've worked ourselves into a set of stupidities when really -- I'll say it -- we might want want longer, more thoughtful exams." And those exams might cost more.

Nancy Grasmick, a previous Maryland education chief, saw the drawbacks of these transitions. "We lost something when we went to a multiple-choice test that did not require writing but required filling in the right circle," Grasmick said.

Such changes can bring anxiety for the test takers. Gerard Robinson, the former education chief of Florida and Virginia, put it this way: "I won't pretend that tests don't matter and there's no anxiety -- but I also tell people there's anxiety with sex. There's anxiety with sex, but there isn't any talk about getting rid of that."

For his study, Chingos was able to procure testing contracts from 44 states and Washington, D.C., and found that, on average, states spend about $27 on testing per student between grades three and nine. In general, he found that smaller states spend more: D.C. spends $114 per student, whereas New York spends only $7.

"This relatively low level of spending on assessment, combined with concerns that the quality of tests in many states is not high enough to use them for high-stakes purposes such as teacher evaluation, strongly suggests that states should seek efficiencies in order to absorb budget cuts without compromising test quality or to free up resources that could be reinvested in upgrades to assessment systems," Chingos wrote.

"We don't spend much on testing in this country," he said, "perhaps we're spending less than we should."

A Dutch court on Wednesday ruled that few of Galaxy smartphones and tablets violate an Apple patent in the most recent round of the mobile giants? legal battle worldwide.

According to the court?s order Samsung has to pay Apple damages, evaluated by the profits made by its sales. This recent suit was in relation to the Android operating system versions 2.2.1 and 3.0 used on Galaxy smartphones and tablets.

This is one among the multiple patent lawsuits between Samsung and Apple in 10 different countries. This is the aftermath of their battle to rule the lucrative mobile market and triumph over consumers with their newest gadgets.

Last month, in an introductory decision a U.S trade panel judge ruled that Samsung infringed Apple patents to make its phones and tablets. Samsung also won a court case last month when a Dutch court ruled the company did not violate an Apple patent using certain multi-touch techniques in manufacturing its smartphones and tablets.

Women 16-49 at risk of multiple pollutants, which could harm brain development of fetuses and babies

ScienceDaily (Nov. 28, 2012) ? In a new analysis of thousands of U.S. women of childbearing age, Brown University researchers found that most exceeded the median blood level for two or more of three environmental pollutants that could harm brain development of fetuses and babies: lead, mercury, and polychlorinated biphenyls (PCBs).

In a recent study, more than half of women of childbearing age had median or higher levels of at least two of three pollutants that could harm brain development. Nearly 23 percent of American women of childbearing age met or exceeded the median blood levels for all three environmental chemical pollutants -- lead, mercury, and PCBs -- tracked in an analysis of data on thousands of women by Brown University researchers. All but 17.3 percent of the women aged 16 to 49 were at or above the median blood level for one or more of these chemicals, which are passed to fetuses through the placenta and to babies through breast milk.

The study, published in advance online Nov. 15 in the journal Environmental Research, identified several risk factors associated with a higher likelihood of a median-or-higher "body burden" for two or more of these chemicals.

The three pollutants are of greatest interest because they are pervasive and persistent in the environment and can harm fetal and infant brain development, albeit in different ways, said study lead author Dr. Marcella Thompson. But scientists don't yet know much about whether co-exposure to these three chemicals is more harmful than exposure to each chemical alone. Most researchers study the health effects of exposure to an individual chemical, not two or three together.

"Our research documents the prevalence of women who are exposed to all three of these chemicals," said Thompson, who began the analysis as a doctoral student at the University of Rhode Island College of Nursing and has continued the research as a postdoctoral research associate for Brown University's Superfund Research Program with co-author Kim Boekelheide, professor of pathology and laboratory medicine. "It points out clearly the need to look at health outcomes for multiple environmental chemical co-exposures."

Most of the childbearing-age women -- 55.8 percent -- exceeded the median for two or more of the three pollutants.

Risks of exposure

Data were collected between 1999 and 2004 from 3,173 women aged 16 to 49 who participated in the Centers for Disease Control and Prevention National Health and Nutrition Examination Survey (NHANES). The survey was designed to represent the national population of 134.5 million women of childbearing age. Because the original study also elicited a wide variety of information on health behaviors, socioeconomic and demographic characteristics, Thompson and Boekelheide were able to identify specific risk factors associated with increased odds of having higher blood levels of lead, mercury, and PCBs.

They found several statistically significant risk factors. The most prominent among them was age. As women grew older, their risk of exceeding the median blood level in two or more of these pollutants grew exponentially to the point where women aged 30 to 39 had 12 times greater risk and women aged 40 to 49 had a risk 30 times greater than those women aged 16 to 19.

Thompson said women aged 40 to 49 would be at greatest risk not only because these chemicals accumulate in the body over time, but also because these women were born in the 1950s and 1960s before most environmental protection laws were enacted.

Fish and heavy alcohol consumption also raised the risk of having higher blood levels. Women who ate fish more than once a week during the prior 30 days had 4.5 times the risk of exceeding the median in two or more of these pollutants. Women who drank heavily had a milder but still substantially elevated risk.

Fish, especially top predators like swordfish and albacore tuna, are known to accumulate high levels of mercury and PCBs, Thompson said. However, there is no known reason why they found a statistically higher association between heavy drinking and a higher body burden of pollutants.

One risk factor significantly reduced a woman's risk of having elevated blood levels of the pollutants, but it was not good news: breastfeeding. Women who had breastfed at least one child for at least a month sometime in their lives had about half the risk of exceeding the median blood level for two or more pollutants. In other words, Thompson said, women pass the pollutants that have accumulated in their bodies to their nursing infants.

Although the study did not measure whether women with higher levels of co-exposure or their children suffered ill health effects, Thompson said, the data still suggest that women should learn about their risks of co-exposure to these chemicals well before they become pregnant. A woman who plans to become pregnant in her 30s or 40s, for example, will have a high relative risk of having higher blood levels of lead, PCBs, and mercury.

"We carry a history of our environmental exposures throughout our lives," Thompson said.

A lease-to-own (LTO) transaction is one in which a potential homebuyer occupies the home as a tenant but has an option to purchase it within a specified period at a specified price. In exchange, the potential buyer pays a nonrefundable option fee upfront plus a monthly rent.

In a recent article, I noted the intense interest in LTO deals today by wannabe homebuyers who can't qualify for the mortgage they need to make a purchase now.

Despite the large demand, not many LTO deals are being done. They are very complicated, and most potential buyers and sellers don't know where to go to get help. Further, most sellers view the LTO as a last resort rather than as a potentially profitable investment. In addition, there is no marketplace where potential buyers and sellers can connect.

To deal with these problems, I developed a three-part plan. Part 1 focusing on contractual complexity was to develop with Jack Pritchard a checklist of all the major provisions that might be included in an LTO, explaining the implications of each for both buyer and seller.

The checklist can be used as a negotiating platform for the two parties, who can turn the results over to a local lawyer for conversion into a contract. This list is on my website at Lease-to-Own Home Purchases: Huge Demand But Few Deals.

Part 2 focusing on seller reluctance is an LTO calculator developed with Chuck Freedenberg, and is the subject of this article. The calculator allows potential sellers to view an LTO deal as an investment generating an attractive rate of return, relative to what the seller could obtain by selling at the best price obtainable in the current market.

The investment return is net of the costs of ownership during the option period, including mortgage interest payments, property taxes, homeowners insurance and other expenses of ownership.

Viewing an LTO as a profitable investment should make it a more attractive option to sellers. The potential savings on real estate sales commission, not included in the return on investment, would be icing on the cake.

Here is an example. The seller could get $100,000 if he placed the house on the market today. The balance on his 6 percent mortgage is $60,000, giving him homeowner equity of $40,000 if he sells now. If he does an LTO, the costs of ownership during the option period sum to $610, which includes a $500 mortgage payment, but he is paid an option fee and a monthly rent. In addition, the option price may be higher than the current market price.

The calculator shows the following combinations of option fee, monthly rent and option price that will generate a 10 percent yield over a 12-month option period:

  • Option fee of $1,000, monthly rent of $610, option price of $100,660.
  • Option fee of $1,000, monthly rent of $501, option price of $102,000.
  • Option fee of $654, monthly rent of $610, option price of $101,000.

Of course, the prospective buyer may not find any of these options desirable; among other reasons, she might need a longer option period than 12 months.

A seller and a buyer negotiating a deal can use the calculator together to find the best set of terms that are satisfactory to both.

Negotiations between buyers and sellers at the outset will probably focus on the rate of return, which is based on an estimate of current property value used to calculate it. In setting the current value, we recommend that the two parties agree to accept the judgment of an appraiser.

Part 3 of my plan to develop an LTO market is to provide an online forum where potential buyers and sellers can interact. Sellers would take the initiative in presenting information about the house for sale, and would provide a range of options acceptable to themselves from which potential buyers could make a selection. The table illustrates this approach. Stay tuned.

    NWAS Abroad: Detailing Day at Matrix Integrated | Northwest Auto ...

    Ever since we expanded into our new space in Lynnwood we?ve become quite comfortable with our little corner of automotive nirvana. Despite being a bit farther out from Seattle proper than some clients may like, the workflow has been consistent, busy, and booked out. So booked out, in fact, that we?ve been getting requests from interested parties outside of Washington & even the US that want to experience the full NWAS treatment. We?re not a franchise, and by most industry standards we?re still a very small shop, so requests to work abroad whether they?re in Oregon or Dubai, are handled with the utmost care!

    For our most recent Detailing Day abroad, proximity was priority. After lining up a variety of automobiles and the most intensive?automotive reconditioning ever thought physically possible for one incredible day only, we designated Matrix Integrated as our rally point bravo and got to packing supplies in the van.

    Just ahead of us was 3 hours of driving and nearly 200 miles to cover in what turned out to be one of the hottest days on record history.

    Good thing we brought fans.

    Matrix Integrated is an easy spot to miss if you?re not sure what you?re looking for. It sits unassumingly tucked away right off SW Macadam Ave., looking like any standard old warehouse,?lending a low profile to the German powerhouses that hide right behind the big bay doors.

    Given their Bavarian specialties, Matrix Integrated was the perfect locale for what turned out to be a primarily German detail day. The stacked roster had us washing, waxing, vacuuming and wiping down a handful of Audi A3s, A6s, a beautiful Suzuka Grey R8, a VW Jetta, and a couple prized Porsches (including one from the Matrix Integrated stable, rounding out 8 vehicles in total.) Each vehicle scheduled was receiving a service similar to the one that preceded it (mostly Enthusiast Details with a few twists thrown in); so with our buckets soaped and rotaries whirring away we began a seemingly endless assembly line of detailing.     The sport of horse racing goes back a long, long way. It goes back to circa 4,500 BC when nomadic Central Asian tribes domesticated horses for the first time. Ever after, horse-racing has reigned supreme as a sport fit for Kings.

    From the beginning of recorded history, horse racing has been depicted as an organised and popular sport common to all of the world's major civilizations. The Olympic Games of ancient Greece featured events involving both mounted and chariot racing. The sport was then taken up by the Romans. Mounted and chariot horse racing became major areas of enterprise in Roman Empire days; these events were the product of breeding programs with imported bloodlines and extensive training programs. Horseracing had all elements of legalized betting like bookies, proper racing tracks, hit tips, scandals and, red hot entertainment and excitement. Horse racing saw a decline that coincided with the Roman Empire's decline. It began to pick up speed once more once mankind was well into a more modern era.

    Horse racing took a professional turn as long ago as the twelfth century, when English Crusader knights came back in the company of Arab horses. This set off a trend that lasted for the forthcoming period of hundreds of years: more and more Arab stallions were imported for crossing with English mares. The ensuing offspring were a real mix of speed and endurance. These cross bred horses were the forefathers of today's horse racing breeds.

    As quantum technological jumps in transport and other fields of human concern took place in the 19th century and later , thousands of people became hooked on watching horse races and gambling on racing horses. Horseracing started to get intensive coverage in distinguished newspapers, and gambling volumes consistently increased. The arrival of organised on-site bookmakers brought along a complete sea change. Random and sometimes illegal, sometimes unethical practices led to a moderately successful Jockey Club effort to establish really high standards of order, discipline and integrity that ensured the sport's continued well being.

    All around the world, attendance at race courses has been shooting up right into the early part of this century. There had been a decline in attendance during the 1970s and 1980s. The technology wonder of online web wagering has influenced horse racing in ways never conceived of earlier.     How To Boost Morale In A Virtual Workplace - Business Insider

    One of the most dominant trends in the workplace is the rise of the virtual team. Whether by design or necessity, more and more people are working outside the office but on the same sorts of multi-person long term projects with the same demands for teamwork as always.

    For insight, we spoke to Katherine Graham-Leviss, the founder of XBInsights, a data-based talent assessment and coaching company which itself has a network of coaches that work virtually.?

    By far the most important thing is that managers know the members of their virtual teams, and put the time in to know how they like to communicate in that environment. They can use that information to motivate them and avoid the behavioral pitfalls that occur in a virtual environment.?

    Below is a lightly edited transcript of our conversation:

    How can employers motivate employees when they have less face time?

    There are a couple of consistencies that I see in this, and one, it's really about communications skills. Oftentimes people don't have good communication skills and its a real issue, and the other thing that I see, it's tough virtually for executives that we deal with to keep their finger on the pulse of what people are doing without constantly calling people. I think that communication piece is really critical.

    The kind of work that I do and where I really get involved is in that communication piece and really helping leaders understand each of their direct reports' real communications preferences and needs, because once they understand those things, they can be much more effective in reading, guiding, directing, and motivating each individual. I think it's really up to the leader or the manager to really understand those communication preferences of each individual and put those into action.

    Are there certain communications issues that execs have that are amplified in a virtual setting??

    I think that there are a couple of things that happen. So for example, a lot of times, there's email communication in a virtual environment. Email communications get misread. Things aren't conveyed in the proper way because you can't see the body language of people and the visual cues, and so a lot of times information will be miscommunicated. Especially, and this is probably more obvious, in situations where there may be conflict.

    Are there particular steps that can be taken to avoid Miscommunication?

    Some people prefer ? and are comfortable with ? email communication. Others need verbal communication and interaction. And others need a combination of both of those things, and so the work that I do is really around understanding the communication preferences of each individual and what works best for each individual, because we've found that a one-size-fits-all approach does not work.?

    So the best thing to motivate and boost morale is being aware of individual preferences?

    That's right. You have to a have a communication strategy that really caters to each individual in order to be truly effective.

    Is there a particular communications strategy that's best for motivating virtual teams?

    I will tell you that if you have any visual communication technology, it's really much more effective. In the absence of more high tech options, a lot of our teams are using Skype and any technology like that where they can get some of that visual communication and interaction. ...[O]ur team does of a lot of forward work, so we tend to be good listeners, good phone communicators, but not everybody is. As a matter of fact, most people aren't. And so, any time you can take advantage of that type of technology, you should, more and more. My team is asked to do global coaching and we use that technology in the absence of any high tech stuff.

    Are there additional issues with high maintenance team members with less face time?

    My definition of a high maintenance employee would also be somebody who's a high performer. In that case what happens is you have to really clearly communicate the expectations and be on the same page with them. What they tend to do is anything to get the results. They'll break the rules, they'll plow over other people. They're so driven that they tend not to think about how other people might be thinking or receiving the way in which they communicate, and that's why I think that it's so important ? for that person in particular ? that there's consistent and open communication with very clear feedback and expectations. The issue with those kinds of people is that they don't want to be evaluated on the process, they want to be evaluated on the fact that they got the result, so they like autonomy, but there's got to be some clear communication and guidelines so they don't create a mess.

    Once leaders understand that they have to set those guidelines and those boundaries then even managing high maintenance, high performance employees becomes easier.

    How can you find the best people for a virtual team and keep them motivated?

    I think that not everybody's built to work virtually. A lot of our coaches who have been with me 9 and 10 years work out of their homes. And there are some who need to go to an office every day, so we've set up offices even though as a team we work virtually, because they need to go to that office; it's too difficult for them to work in their home setting. A lot of times we're looking at scientific assessment data because we're using our profile system to hire people.?The data can point to, not will somebody work well in a virtual team, but can they work well independently, and what is it that they really need. Some people really need that people interaction, some people need that structure. If they're in a virtual environment and we know those things, we can better set them up for success.?

    So find the data, know your people, and build some structure for them?

    That's right. And find some consistency in how you interact with them.

    How do you plan with having to work unexpectedly as a virtual team?

    I see this one all the time. I have a client ? we were just talking about this ? that there are certain people who are very good at multitasking and they can work [on] the road, but what ends up happening when you have a team doing that and they're out of the office a lot is that everybody has their own individual agendas, and there's a lack of communication and all of the consistent team types of communication fall to the wayside because everybody's traveling. It really becomes a big issue. And with a lack of a plan and a strategy and check ins and checkpoints and virtual staff communications that [are] mandatory, it really becomes a problem, so there's got to be a communication plan for how people are expected to interact and show up and communicate when everybody's on the road.

    So when it comes to keeping a virtual team motivated, structure can be even more important?

    Yes.?

    8 Great Windows 8 Features for Business

    On the surface, Windows 8 has what it takes to make business users happy. Microsoft?s new OS offers the touch-friendly interface and responsiveness of the iPad, plus the versatility of the traditional desktop and the ability to run tons of traditional apps.

    However, many are predicting a not-so-happy ending for the business community. ?Businesses will choose to drag their feet on adopting Windows 8,? said Al Gillen, IDC?s vice president of system software, ?for the simple reason that they don?t want to be the ones to find out what problems exist in the product.?

    An IDC study confirms Gillen?s sentiments. According to the firm?s research, Windows 8 Pro and Windows 8 Enterprise will make up just 10 percent of the PC market in 2014. That?s a pretty small chunk given Windows 7 Professional and Windows 7 Enterprise accounted for 50 percent of the market in 2011.

    But are these low expectations proof that business leaders should avoid Windows 8 altogether, or does it pose a rare opportunity for IT managers to advance to a forward-thinking platform with smart features for enterprise and small business users? These eight Windows 8 features may compel you to move sooner rather than later.

    1. Laptop power plus tablet convenience

    It?s no secret Windows 8 is designed to rival the Apple iPad and Android tablets. Right now, Windows is nonexistent on tablets, while iOS dominates with 68 percent market share, according to research firm Strategy Analytics. Android-based tablet devices have around 29 percent of the tablet market.

    But what isn?t often discussed is the enhanced functionality Windows 8 affords users who want to navigate between a laptop and a tablet ? all without switching between two pieces of hardware.

    The list of Windows 8 hybrids that transform from a laptop to a finger-ready tablet include systems with detachable keyboards such as the HP Envy x2 and Acer Iconia W510, sliding convertibles such as the Sony VAIO Duo 11 and systems with back-bending displays such as the Lenovo IdeaPad Yoga.

    Such versatile designs are sure to appeal to job sectors where tablets are popular. According to studies by NPD and Vertic, the financial, health care, education and government industries are increasing their tablet usage, thanks to the need to take quick notes, make presentations on the fly, execute research online and send emails. The Vertic study also shows that converting workflow to a slate interface improves employee response time, increases team decision-making time and quickens resolution of critical issues.

    A Windows 8 device puts that performance enhancement into business users? hands, while simultaneously giving them a device that can easily transition into a laptop for traditional productivity assignments.

    2. Office, evolved

    As of press time, Microsoft Office 2013 didn?t have an official release date, but we know the new lineup ? Microsoft Access, Excel, OneNote, Outlook, PowerPoint, Publisher and Word 2013 ? will be identically available for both Windows 7 and Windows 8. Via previews, we also know that the new suite includes plenty of touch-friendly interface tweaks for Windows 8 machines. Those perks join much improved tools for better workflow management and team collaboration too. That is, if managers opt into Microsoft?s new yearly subscription prices, which include local installs of Office software and access to cloud-based syncing services.

    Microsoft?s new set of Office 365 Web apps lets users create, edit and share documents online, giving business users a built-in architecture for managing and editing documents through the Web.

    For instance, in Excel, PowerPoint and Word 2013 documents, users can add comments to files, and readers who want to respond to those comments can do so directly in the document or they can email, IM, text or even video chat with team members (via Microsoft?s corporate communications client Lync or via Skype).

    For teams with a roster of road warriors or work-anywhere employees, Microsoft Lync includes the ability to host audio and video meetings complete with screen sharing and high-definition video streaming.

    Designed for organizations with one to 10 employees, the Office 365 Small Business Premium subscription package costs $149 per year and includes all Microsoft?s software, even Lync. Each user can install Office on up to five Windows 8 PCs or tablets as well as Mac computers.

    3. Better virus protection and security

    In Windows 7, Microsoft Defender guarded against invasive spyware and pop-up ads, but it lacked protection against anti-virus threats such as trojans, worms and bot-net attempts. With Windows 8, Defender gets a bolder shield to protect against all of the above, right from the operating system?s first launch.

    The new Defender (shown) provides only basic anti-virus defense, but will likely save IT managers or small business owners the time to pay for and install third-party virus protection from McAfee or Norton. Plus, when paired with Windows 8?s new SmartScreen technology for verifying downloads against a list of reputable files, viruses and other malware are sure to have a harder time cracking IT-deployed devices.

    Under the adage, ?You can never be too safe,? Microsoft added other defensive weaponry to Windows 8?s arsenal. Namely, there?s Trusted Boot and Measured Boot, two new protections against rootkits that attack during the PC boot process.

    A third tool is Enhanced BitLocker. This encryption weapon can now render whole hard drives unreadable to uncredentialed users, which moves beyond scrambling particular pockets of data such as previous versions of Windows. Plus, BitLocker now supports Federal Information Processing Standards (FIPS) for encryption, making it a trustworthy tool for government office workers.

    4. Improved performance and smarter backups

    Gone are the days of twiddling your thumbs, grabbing coffee or doing your taxes while waiting for Windows to load. Windows 8 not only launches much faster than its Windows 7 forebear, it uses a new boot-up bridge called the Unified Extensible Interface (UEFI) to access graphical drivers before the operating system is fully active. Earlier access to visual graphics helps replace old-school boot visuals with a more interesting ? and shorter ? sequence of visual cues. In our tests, a Lenovo ThinkPad T430 running Windows 8 booted in 25 seconds, half the time it took the same notebook to land on the Windows 7 home screen.

    When it comes to restoring a Windows PC to factory settings, Microsoft eliminated the need to back up files, data and settings. With a new tool called Refresh, Windows users can essentially reinstall the OS while maintaining their own settings, document libraries and customizations. After the OS is restored, all saved data, settings and Metro apps are automatically reinstalled. Only desktop apps must be restored manually.

    Windows 8 also borrows a strong backup tool from Apple. A new feature called File History saves a running timeline of all files ? just like Mac OS X?s Timeline feature ? to make backing up important documents and data an automated process. That?s sure to save IT managers time.

    5. More efficient wireless connection management

    When it comes to wireless connections, Windows 8 is vastly improved. First, the new Wi-Fi manager is smarter and faster. Rather than simply search out the nearest Wi-Fi network, the manager measures each signal?s throughput and chooses the source with the strongest bandwidth instead.

    There?s also a Connection Standby mode, for updating data while a Windows 8 laptop or tablet is asleep. Those worried about battery life drain can place the device in Airplane Mode, just like most smartphones.

    For employees who use mobile broadband to connect to get online, Windows 8 builds in a data meter to keep track of your usage. This is a great way to save the company money if you?re worried about overage fees. Last but not least, drivers for plug-and-play mobile broadband devices are built into the OS. Now, rather than downloading third-party broadband software to connect to the Web, devices that connect over 3G/4G data networks should work automatically. Their networks should appear in the same Wi-Fi manager as other wireless connections options.

    6. Exchange ActiveSync built-in

    Email accounts are a cinch to set up on Windows 8 PCs. That?s because for the first time ever, Outlook 2013 has built-in support for Exchange ActiveSync, the email solution that makes it very simple to connect email accounts to Android, iOS or Windows Phone devices. With ActiveSync ingrained in the OS and Outlook, savvy end-users or small business managers should have no problem connecting multiple email inboxes, syncing calendars and managing contacts on Windows 8 laptops or tablets.

    7. Windows to Go makes Windows 8 plug-and-play on any PC

    Imagine how happy business travelers would be if they could carry a Windows PC in their pocket instead of their laptop bag. Windows to Go, available only in Windows 8 Enterprise, allows just that by putting all the power of Windows 8 on a USB key, allowing users to plug into any Windows 7 or Windows 8 machine to access their system. The bootable OS image includes support for any apps added to the image by support staff.

    There are some caveats, though. You won?t be able to access the Windows Store due to strict hardware licensing (so no downloading new apps). You?ll also love hibernation mode and access to the host computer?s storage drive.

    8. Better Support for Virtualized systems and remote desktop support

    If you?re an IT manager juggling loads of Windows XP legacy apps, you probably loved the Virtual PC feature in Windows 7. That?s because that tool lets users run a full, virtual install of Windows XP in a window within the Windows 7 environment, which meant fleet managers didn?t need to upgrade tons of dated machines.

    For Windows 8, Microsoft offers multiple virtualization options, including a tool to use Windows XP as a virtual OS on a Windows 8 machine. The PC-within-a-PC tool is useful in other ways as well. For instance, with Microsoft Server 2012 and a technology called User Experience Virtualization, employees can access a remote, server-side and virtual copy of their Windows 8 desktop, even if the local machine runs Windows 7. Another example uses what Microsoft calls Virtual Desktop Infrastructure (VDI) to create multiple virtual PCs on one physical computer. So, if an office has an equipment crunch, one laptop can be assigned to several users, each with their own distinct virtual desktop that is complete with independent customizations, settings and personal setups.

    Plus, because Windows 8 runs Hyper-V, the evolutionary upgrade to Windows Virtual PC (via Microsoft Server 2012), there?s roughly no slow-down between the actual interface and the virtual one. That means even a virtualized version of Windows 8 running on a touch-screen device can be used with all the touch and gesture controls native to that OS.?

    Pack your bags for a move to Mars

    Elon Musk, the billionaire founder and CEO of the private spaceflight company SpaceX, wants to help establish a Mars colony of up to 80,000 people by ferrying explorers to the Red Planet for perhaps $500,000 a trip.

    In Musk's vision, the ambitious Mars settlement program would start with a pioneering group of fewer than 10 people, who would journey to the Red Planet aboard a huge reusable rocket powered by liquid oxygen and methane.

    "At Mars, you can start a self-sustaining civilization and grow it into something really big," Musk told an audience at the Royal Aeronautical Society in London on Nov. 16. Musk was there to talk about his business plans, and to receive the society?s gold medal for his contribution to the commercialization of space.

    Mars pioneers
    Accompanying the founders of the new Mars colony would be large amounts of equipment, including machines to produce fertilizer, methane and oxygen from Mars? atmospheric nitrogen and carbon dioxide and the planet's subsurface water ice.

    The Red Planet pioneers would also take construction materials to build transparent domes, which when pressurized with Mars? atmospheric CO2 could grow Earth crops in Martian soil. As the Mars colony became more self sufficient, the big rocket would start to transport more people and fewer supplies and equipment. [Future Visions of Human Spaceflight]

    Musk?s architecture for this human Mars exploration effort does not employ cyclers, reusable spacecraft that would travel back and forth constantly between the Red Planet and Earth ? at least not at first

    "Probably not a Mars cycler; the thing with the cyclers is, you need a lot of them," Musk told Space.com. "You have to have propellant to keep things aligned as (Mars and Earth?s) orbits aren?t (always) in the same plane. In the beginning you won?t have cyclers."

    Musk also ruled out SpaceX's Dragon capsule, which the company is developing to ferry astronauts to and from low-Earth orbit, as the spacecraft that would land colonists on the Red Planet. When asked by Space.com what vehicle would be used, he said, "I think you just land the entire thing."

    Asked if the "entire thing" is the huge new reusable rocket ? which is rumored to bear the acronymic name MCT, short for Mass Cargo Transport or Mars Colony Transport ? Musk said, "Maybe."

    Musk has been thinking about what his colonist-carrying spacecraft would need, whatever it ends up being. He reckons the oxygen concentration inside should be 30 to 40 percent, and he envisions using the spacecraft?s liquid water store as a barrier between the Mars pioneers and the sun.

    A $500,000 ticket
    Musk?s $500,000 ticket price for a Mars trip was derived from what he thinks is affordable.

    "The ticket price needs to be low enough that most people in advanced countries, in their mid-forties or something like that, could put together enough money to make the trip," he said, comparing the purchase to buying a house in California. [Photos: The First Space Tourists]

    He also estimated that of the 8 billion humans that will be living on Earth by the time the colony is possible, perhaps one in 100,000 would be prepared to go. That equates to potentially 80,000 migrants.

    Musk figures the colony program ? which he wants to be a collaboration between government and private enterprise ? would end up costing about $36 billion. He arrived at that number by estimating that a colony that costs 0.25 percent or 0.5 percent of a nation?s gross domestic product (GDP) would be considered acceptable.

    The United States' GDP in 2010 was $14.5 trillion; 0.25 percent of $14.5 trillion is $36 billion. If all 80,000 colonists paid $500,000 per seat for their Mars trip, $40 billion would be raised.

    "Some money has to be spent on establishing a base on Mars. It?s about getting the basic fundamentals in place," Musk said. "That was true of the English colonies (in the Americas); it took a significant expense to get things started. But once there are regular Mars flights, you can get the cost down to half a million dollars for someone to move to Mars. Then I think there are enough people who would buy that to have it be a reasonable business case."

    The big reusable rocket
    The fully reusable rocket that Musk wants to take colonists to Mars is an evolution of SpaceX's Falcon 9 booster, which launches Dragon.

    "It?s going to be much bigger (than Falcon 9), but I don?t think we?re quite ready to state the payload. We?ll speak about that next year," Musk said, emphasizing that only fully reusable rockets and spacecraft would keep the ticket price for Mars migration as low as $500,000.

    SpaceX is already testing what Musk calls a next-generation, reusable Falcon 9 rocket that can take off vertically and land vertically. The prototype, called Grasshopper, is a Falcon 9 first stage with landing legs.

    Grasshopper has made two short flights. The first was on Sept. 21 and reached a height of 6 feet (2 meters); the second test, on Nov. 1, was to a height of 17.7 feet (5.4 m). A planned milestone for the Grasshopper project is to reach an altitude of 100 feet (30 m). [Grasshopper Rocket's 2-Story Test Flight (Video)]

    "Over the next few months, we?ll gradually increase the altitude and speed," Musk said. "I do think there probably will be some craters along the way; we?ll be very lucky if there are no craters. Vertical landing is an extremely important breakthrough ? extreme, rapid reusability. It?s as close to aircraft-like dispatch capability as one can achieve."

    Musk wants to have a reusable Falcon 9 first stage, which uses Grasshopper technology, come back from orbit in "the next year or two." He then wants to use this vertical-landing technology for Falcon 9?s upper stage.

    Musk hopes to have a fully reusable version of Falcon 9 in five or six years, but he acknowledged that those could be "famous last words."

    A rocket stepping stone
    Another stepping stone toward the planned reusable Mars rocket is SpaceX?s Falcon Heavy launcher. With a first flight planned for next year from Vandenberg Air Force Base in California, the Heavy is a Falcon 9 that has two Falcon 9 first stages bolted on either side.

    Musk expects the Falcon Heavy to launch from Florida's Cape Canaveral eventually. This triple-first-stage rocket will be able to put 116,600 pounds (53,000 kilograms) into a 124-mile (200 kilometers) low-Earth orbit. But the Falcon Heavy is still much smaller than Musk?s fully reusable Mars rocket, which will also employ a new engine.

    While Musk declines to state what the Mars rocket?s payload capability will be, he does say it will use a new staged combustion cycle engine called Raptor. The cycle involves two steps. Propellant ? the fuel and oxidizer ? is ignited in pre-burners to produce hot high-pressure gases that help pump propellant into the engine?s combustion chamber. The hot gases are then directed into the same chamber to aid in the combustion of the propellants.

    Because Raptor is a staged combustion engine ? like the main engines of NASA's now-retired space shuttle fleet ? it is expected to be far more efficient than the open-cycle Merlin engines used by the Falcon 9.

    While the Falcon 9?s engines use liquid oxygen (LOX) and kerosene, Raptor will use LOX and methane. Musk explained that "the energy cost of methane is the lowest, and it has a slight ISP (specific impulse) advantage over kerosene and doesn?t have any of the bad aspects of hydrogen." (Hydrogen is difficult to store at cryogenic temperatures, makes metal brittle and is very flammable.)
